RESPONSIBILITY
1)      All bookings are accepted on condition that Afrinental Safaris & Holidays and/or other subsidiaries, affiliated companies, independent suppliers who are not affiliates with Afrinental Safaris & Holidays in any way, act only as Booking Agents for the Owners, Operators and Contractors in all matters relating to hotel accommodation, tours, transport whether by air, rail, road, motor vehicle, ships/boat or any other means.

2)      All tickets/vouchers issued by those described above are subject to any/all terms and conditions under which such services are offered or provided. Issuance and acceptance of such tickets/vouchers shall be deemed to be consent to the further condition that neither Afrinental Safaris & Holidays nor their subsidiaries, independent suppliers etc., in Kenya or abroad are or shall become liable or responsible in any way in connection with such means of transportation, accommodation or other services or for any loss, injury, damage to or in respect of any person or property howsoever caused or arising from any delays in transportation or consequences, therefore.

3)      All scheduled airline flights are sometimes subject to overbooking and/or cancellation. If this occurs, Afrinental Safaris & Holidays and/or its correspondent companies will do all in their power to assist clients in boarding flights or finding alternative arrangements.  It should be understood that this is done as a courtesy to guests and Afrinental Safaris & Holidays cannot be held responsible for denied boarding nor the additional costs thus incurred.

4)      At some of sites you will visit on your tour, optional activities provided by other independent suppliers not affiliated to/with Afrinental Safaris & Holidays in any way will/may be offered.  Some of these activities carry with them inherent risks like attack by wild animals, injury to self, etc., which can cause serious personal injury or harm.  These activities include, but are not necessarily limited to:

1.      Bush walking safaris
2.      Hot air ballooning
3.      Mountain Climbing
4.      Horseback riding
5.      Camel riding
6.      Gorilla and Chimpanzee Tracking
7.      etc.

Please note that although the suppliers take precautions to guard against such dangers, your safety cannot be guaranteed.  Should you choose to participate in such activities during your tour, you are free to do so.  However, you must understand that such participation will be at your own risk and that Afrinental Safaris & Holidays cannot assume any responsibility for your safety or that of your property.

5)      Afrinental Safaris & Holidays and/or their representatives reserve the right to withdraw such a tour or any part of it, to make such alterations in the itinerary as to them seem necessary or desirable, to refuse to accept or retain as a member of the tour any person at any time and to pass on to tour members any expenditure occasioned by delays or events beyond their control.  In case of any appreciable variable in cost of services covered under this Agreement, Afrinental Safaris & Holidays reserves the right to make such adjustments to price/rate as necessary.

6)      Afrinental Safaris & Holidays shall not be responsible for any loss, damage, delay or failure in performance under this Agreement resulting from acts of God, civil commotion, arrest or restraint by leaders and people, bad weather, closure of ports, quarantine, epidemics or any other event whatsoever arising after signing this Agreement that cannot be avoided or guarded against by the exercise of due diligence or the consequences of which, as may affect the performance of this Agreement, cannot be avoided or guarded against by the exercise of due diligence.  If the cause of the Force Majeure is not eliminated within 90 days, the other party may at its option terminate this Agreement.

PAYMENT POLICY
Except in a few instances where we require more, a 25% deposit is required to make a booking firm.  The total balance is due 35 days before start of tour arrangements.

For reservations made < 45 days before arrival date, the total tour price must be paid to confirm booking

Payment of Tour Price per the Payment Policy constitutes acceptance of the Bookings Terms & Conditions.

CANCELLATION POLICY
Except in a few instances depending on featured properties,
Cancellations received from 45 to 23 days before arrival are subject to a cancellation charge of 20% of the tour cost. Cancellations received from 22 to 6 days before arrival are subject to a cancellation charge of 50% of the tour cost. Cancellations received within 5 days of arrival day are subject to 100% charge cancellation/forfeiture of tour cost.
